Terms of Service for Chat Incognito

1. General Provisions

These Terms of Service define the rules for using the web application "Chat Incognito", available via the Internet. The owner and administrator of the service is Daniel Kotecki, hereinafter referred to as the "Service Provider". The Terms have been prepared in accordance with the applicable provisions of Polish law and European Union law, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR). Using the Service implies full acceptance of these Terms of Service.

2. Definitions

1) Service / Application – the web application "Chat Incognito" enabling anonymous communication between users. 2) User – any natural person using the Service. 3) Service Provider – Daniel Kotecki, the creator and administrator of the Service. 4) Session – a temporary period of User activity in the Service, counted from the moment of starting to use the Application. 5) Technical Data – data necessary for the proper functioning of the Service, such as IP address, session identifier, or browser data.

3. Nature and Scope of Services

The Chat Incognito service allows Users to conduct real-time conversations in an anonymous manner. The Service Provider does not require registration, account creation, or providing data identifying the User. Conversations conducted in the Service are not stored in a database, archived, or analyzed after the session ends.

4. Rules for Using the Service

The User is obliged to use the Service in a manner consistent with applicable law, principles of social coexistence, and good morals. In particular, it is prohibited to publish illegal content, content infringing the rights of third parties, offensive, vulgar content, or content inciting violence, discrimination, or hatred. The Service Provider reserves the right to temporarily or permanently restrict access to the Service in the event of a violation of the Terms.

5. Anonymity and No Permanent Data Storage

Chat Incognito has been designed with respect for Users' privacy. The Service does not store the content of conversations in a database or in system logs. User data is stored solely in the form of a temporary technical session and is automatically deleted no later than 5 hours after the end of the session or inactivity.

6. Personal Data Protection (GDPR)

The data controller is Daniel Kotecki. Data processing is carried out in accordance with the GDPR and is limited exclusively to technical data necessary for the proper functioning of the Service. The data is not profiled, transferred to third parties, or used for marketing purposes. The User has the right to access their data, request its deletion, restrict processing, and lodge a complaint with the President of the Personal Data Protection Office.

7. Liability

The Service Provider is not liable for the content transmitted by Users during conversations. Users bear full responsibility for their actions in the Service. The Service Provider exercises due diligence to ensure that the Service operates continuously and securely, but does not guarantee uninterrupted availability of the Application.
